Leasing
Leasing is the most permanent, long-term decision that a retailer makes. Per location,
this is a task that is done typically every 5 to 10 years by the retailer. The fact that
this is done so infrequently by the retailer and so frequently by the landlord places the
retailer on an uneven playing field with an inherent disadvantage, especially so in better
shopping areas and facilities. Due to the rapid changes in the retail environment in the
last decade, leasing has changed dramatically. Exit clauses, tenant allowances, cotenant
agreements, rent abatement and moratoriums can be negotiated by experts that are knowledgeable
of both tenant and landlord issues and precedents. Demand everything and usually you will
get nothing unless the location is very substandard. To achieve the best lease requires the
skill of a professional.
A single word in leasing can radically change the charges the landlord is legally entitled to
collect from the retailer for years. Leasing, moreover, has changed significantly over the last
ten years. New types of agreements and language have emerged that were never considered a few
years ago. It is extremely difficult for the individual retailer to learn all of these options
